These Terms will apply to any contract formed between us for the sale of Products to you. Please read these Terms carefully and make sure that you understand them before ordering any Products from our site. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products from our site.
We may amend these Terms occasionally so we advise that every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time.
These Terms, and any Contract between us, are only in the English language.
 
OUR PRODUCTS
 
The images of the Products on our site are for illustrative purposes only and the Products may therefore vary slightly from those images.
Variations will occur on natural products
The packaging of the Products may vary from that shown in images on our site.
All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will not process your order.
 
HOW WE USE YOUR PERSONAL INFORMATION
 
We only use your personal information in accordance with our Privacy Policy. Please take the time to read our Privacy Policy, as it includes important terms which apply to you.
We will in any case use the personal information you provide to us to:
Supply you with the Products you have ordered from us;
Process your payment for such Products; and
Inform you about similar products or services that we provide, but you may stop receiving these at any time by contacting us.
 
HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
 
Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process. You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.
The prices payable for goods that you order are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at the time of entering information.
After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. 
We will confirm our acceptance of your order to you by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation). The Contract between us will only be formed when we send you the Dispatch Confirmation.
If we are unable to supply you with a Product you have ordered, for example because that Product is not in stock or no longer available or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund you the full amount of the order price as soon as possible.
 
OUR RIGHT TO VARY THESE TERMS
 
We may revise these Terms from time to time.
Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us.
 
ACCURACY OF CONTENT
 
We have taken great care in preparing the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website. Where the product's correct price is less than the price stated on our site, we will charge the lower amount when dispatching the Products to you. However, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price.
 
Prices for our Products may change from time to time, but changes will not affect any order which we have confirmed with a Dispatch Confirmation.
 
The price of a Product includes VAT or an equivalent tax, where applicable, at the current rate chargeable in the country of your assumed origin. However, if the rate of VAT or equivalent tax changes between the date of your order and the date of delivery, we will adjust the VAT or equivalent tax you pay, unless you have already paid for the Products in full before the change takes effect.
 
Any weights, dimensions and capacities given about the goods are approximate only.
 
PAYMENT TERMS
 
Payment will be taken at the time of order and you will be notified once your order has been despatched.  If for any reason it is not possible to fulfil your order within the time-frame, you will be informed immediately.
We accept payment by credit or debit card via a secure online payment system. Your card details are entered via a secure PCI DSS compliant server. We also accept payments via PayPal.
 
We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you.
Bank charges by the receiving bank on payments to us will be borne by us. All other charges relating to payment in a currency other than pounds Sterling will be borne by you.
If, by mistake, we have under-priced Goods, we will not be liable to supply those Goods to you at the stated price, provided that we notify you before we dispatch it to you.
The price of the Goods does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed on a page of Our Website before we ask you to pay.
 
SECURITY OF YOUR CREDIT CARD
 
We take care to make Our Website safe for you to use.
Card payments are not processed through pages controlled by us. We use one or more online payment service providers who will encrypt your card or bank account details in a secure environment.
If you have asked us to remember your credit card details in readiness for your next purchase or subscription, we will securely store your payment details on our systems. These details will be fully encrypted and only used to process your automatic monthly payments or other transactions which you have initiated.
 
FOREIGN TAXES AND DUTIES
 
If you are not in the UK, we have no knowledge of, and no responsibility for, the laws in your country. You are responsible for purchasing Goods which you are lawfully able to import and for the payment of import duties and taxes of any kind levied in your country.
 
DELIVERY CHARGES
 
Delivery charges vary according to the type of goods ordered. Please note that timescales for delivery and delivery charges will vary depending on the availability of the Products you have ordered and your address.
 
Our delivery charges and times are set out on our delivery and returns page.
Delivery is to UK addresses only.
We cannot ship to PO Box numbers.
• On some occasions we may not be able to accept an order if the delivery address is to a block of flats / apartments. If we choose to accept the order the customer agrees to take full responsibility of the parcel once it has been delivered, we take no responsibilty for missing or stolen parcels from foyers or holding areas; the parcel is classed as delivered if our courier's tracking shows it as having been delivered to the building on the delivery address. If we decide to cancel the order you will be refunded at this point in full.
There are some areas where we cannot deliver to, or will require additional delivery charges to those stated, we will contact you with the necessary information and payment details via email, if you do not wish to proceed, we can cancel the order at this point with a full refund.
We will endeavour to fulfil your order by the estimated delivery date set out in the Dispatch Confirmation, which will be within 30 days after the date of the Dispatch Confirmation unless the Products are pre-order or made to measure items, in which case we will agree the relevant date with you. If we are unable to meet the estimated delivery date for any reason, we will contact you with a revised estimated delivery date.
Delivery will be completed when we deliver the Products to the address you gave us. Cassie’s Gifts and Designs shall not be liable for delays or other disadvantages to the Customer, which result from an incorrect address being supplied at the time of order.
If no one is available at your address to take delivery, we will either leave you a note that the items are being held securely by our courier, in which case, please contact our courier in the manner provided on the undelivered note to rearrange delivery, or the items may be left by our courier with a neighbour or elsewhere in a discreet and secure place which will be notified to you at the time of delivery. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).
You will become the owner of the goods you have ordered once they have been delivered to you and we have received payment in full, including all applicable delivery charges for the full order made by you.
Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
Signing "Unchecked", "Not Checked" or similar is not acceptable
If we agree with you to deliver on a particular day or at a particular time, we will do our best to comply. But no time given is to be treated as contractual. So we are not liable to you for any expense or inconvenience you incur on account of delayed delivery or non-delivery.
Some Goods are so large and heavy that delivery times may be slightly longer. In this case, approximate delivery dates will be given when you place your order.
If a time for delivery is specified on the order, it is an estimate only. We cannot be held accountable for any loss due to delayed times.
We are happy for you to pick up Goods from our shop/ warehouse provided you make an appointment in advance and payment has been received into our bank. 
If you pick up Goods from our premises:
o we will not be able to assist you in loading heavy items;
o Goods are at your risk from the moment they are picked up by you or your Carrier from our shop / warehouse;
o You agree that you are responsible for everything that happens after you take possession of the Goods, both on and off our premises, including damage to property of any sort, belonging to any person.
 
CANCELLATIONS AND RETURNS
 
REFUNDS AND EXCHANGES
 
Terms and conditions on our refunds and exchanges policies are set out on our delivery and returns page.
 
There are no refunds on personalised/bespoke/made to order products or face coverings.
No order can be cancelled at any time on personalised or made to order goods.
 
RETURNS
 
Terms and conditions on our returns policy is set out on our delivery and returns page.
Only products that are returned complete, in perfect condition, unused, unwashed and with the original packaging will be accepted for a refund or exchange. We cannot accept items for a refund or exchange if the goods are not in perfect condition or it is obvious to us that the goods have been used or washed. If the item is not in perfect condition you may not be eligible for a full refund. 
There are no returns on personalised or made to order products or face coverings.
Returns will only be accepted with an accompanying returns form, which will be emailed to you after notification of the return.
Products must be packed carefully using the original packaging, along with the returns form and returned to the address we provide to you. 
For all returns, except where the item is faulty or when we have sent you an incorrect item, goods must be returned at your expense and at your own risk, preferably by recorded delivery.
When returning items you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit. Until you return items to us you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.
Please note we are permitted by law to reduce your refund to reflect any reduction in the value of the Products, if this has been caused by your handling of them other than what is necessary to establish the nature, characteristics and functioning of the Products. If we have inadvertently been charged for the direct cost of returning the Product to us (e.g. where you have elected to 'return to sender'), unless the Product is faulty or not as described we will deduct such direct cost from the refund you would otherwise have been entitled to.
 
CANCELLATIONS
 
In accordance with the Distance Selling Regulations, you have the legal right to cancel your order up to 14 calendar days after the day on which you receive your goods (with the exception of any made to order/personalised items). 
 
If you have received the goods before you cancel your order you will be required to return the item(s) in their original and unopened condition within 14 days.  If you cancel your order but we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at your own cost and risk as soon as possible. No postal charges will be refunded and goods must be returned at your expense and at your own risk, preferably by recorded delivery. You will be refunded within 14 days of receiving the item back.
 
To cancel an order, please notify us in writing by email. You do not need to give us any reason for cancelling your contract. (You may wish to keep a copy of your cancellation notification for your own records.)
You cannot cancel your order if the goods you have ordered are bespoke (i.e. made to order), or in any way personalised.

Please note we are permitted by law to reduce your refund to reflect any reduction in the value of the Products, if this has been caused by your handling of them other than what is necessary to establish the nature, characteristics and functioning of the Products. If we have inadvertently been charged for the direct cost of returning the Product to us (e.g. where you have elected to 'return to sender'), unless the Product is faulty or not as described we will deduct such direct cost from the refund you would otherwise have been entitled to.
 
REFUNDS ON PERSONALISED / MADE TO ORDER PRODUCTS
 
No order can be cancelled at any time on personalised or made to order goods.
In the case of an error on our part with regard to made to order products, we will correct this by exchange at our expense.  If you have made an error then we will do what we can to assist in putting this right.  We do however reserve the right to make a charge for this service as well as the additional postal charges.
 
CANCELLATION BY US
 
We reserve the right not to process your order if:
We have insufficient stock to deliver the goods you have ordered;
We do not deliver to your area; or
One, or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.
 
FAULTY OR DAMAGED ITEMS
 
Terms and conditions on our faulty or damaged items policy is set out on our delivery and returns page.
Please examine the Goods received from us immediately you receive them.  All faulty or damaged items must be logged within 24 hours of receipt by email or telephone.
Before you return the Goods to us, please carefully re-read the instructions and check that you have assembled it correctly, and/or complied with any provisions relating to the power supply, plugs and sockets, etc.
Any attempt to repair the item may affect your entitlement to a refund or exchange.
Please follow the returns procedure as set out on our delivery and returns page. The item must be returned in the original packaging within 7 days and upon receipt we will make contact to discuss whether a refund or replacement will be issued or a possible repair.
If the item is agreed to be faulty all further costs will be covered by us, Proof of postage must be retained and return postage will be paid for.
 
NON RECEIPT OF GOODS
 
LATE DELIVERY
 
In the event of dispatched items being delayed beyond our estimated delivery times or lost in the post, we will offer a replacement or refund. We do please ask that you to wait the set time after the date of dispatch, outlined in the dispatch confirmation email, before contacting us. We will ask for a confirmation of the delivery address and we will also ask you to please check at your local post/sorting office, in case your parcel is being held there.
 
We must be informed of non-receipt of goods in a timely manner. Any declaration of non-receipt of goods made 3 weeks after the goods should have arrived may not be considered.
 
If enough time has passed and the above checks have been completed, the parcel may be classed as lost. Please note that an order can only be classed as lost by Royal Mail if at least 15 working days or more have passed since the item was due to be delivered to a UK address (20 working days or more for Europe). Refunds or replacements will not be processed until that time has passed, unless otherwise agreed.
 
RISK AND OWNERSHIP
 
Risk of damage to or loss of the goods passes to you at the time of delivery to you. If you choose to use your own courier then the risk passes to you as soon as the goods are handed to your courier. You will only own the goods once they have been successfully delivered.
 
LIABILTY
 
We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do; or is due to events which are beyond our reasonable control. 
If an Event Outside Our Control takes place that affects our obligations, we will contact you as soon as reasonably possible to notify you; and our obligations will be suspended. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you as soon as reasonably possible.
 
Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.
 
Unless otherwise expressly agreed by us, we only supply our Products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. You have certain rights as a consumer including legal rights, relating to faulty and/or incorrectly described goods.
 
NOTICES
 
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our email address at cassiesgiftsanddesigns@gmail.com and all notices from us to you will be displayed on our website. 
We reserve the right to change these terms and conditions at any time and you should look through them every time you use our website or purchase from us.
 
LAW, JURISDICTION AND LANGUAGE
 
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
 
PRIVACY
 
You acknowledge and agree to be bound by the terms of our privacy policy.
 
THIRD PARTY RIGHTS
 
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
